Terms of Service

1. Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you and The Franchise (“we,” “us,” or “our”), governing your access to and use of the website at www.thefranchise.app and all related services (collectively, the “Service”).
By creating an account or using the Service, you confirm that you are at least 13 years of age and agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
2. Description of Service
The Franchise is a web-based fantasy football analytics platform designed for dynasty league managers. The Service provides tools including roster analytics, trade evaluation, AI-powered coaching, draft companionship, and league intelligence features. The Service integrates with the Sleeper fantasy sports platform via its publicly available API to retrieve league, roster, and player data on your behalf.
The Franchise is not affiliated with, endorsed by, or sponsored by Sleeper, Inc. “Sleeper” is a trademark of Sleeper, Inc.
3. Accounts and Registration
To use the Service, you must create an account using either an email address and password or Google single sign-on. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
You are solely responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify us immediately at support@thefranchise.app if you suspect unauthorized access. We are not liable for losses resulting from unauthorized use of your account.
Each person may maintain only one account. We reserve the right to suspend or terminate duplicate accounts.
4. Sleeper Integration
The Service accesses league data, roster information, transaction history, and player data from the Sleeper platform via its public API. By providing your Sleeper username, you authorize us to retrieve this data on your behalf. We do not access your Sleeper account credentials, private messages, or any data outside the scope of the publicly available Sleeper API.
Sleeper API availability and data accuracy are controlled by Sleeper, Inc. We are not responsible for interruptions, errors, or changes to the Sleeper API or its data.
5. AI-Generated Content
Certain features of the Service — including Coach AI, the War Room Council, and trade analysis — use artificial intelligence models provided by third-party services (including OpenAI, Anthropic, and Google) to generate analysis, recommendations, and commentary.
AI-generated content is for informational and entertainment purposes only. It does not constitute professional advice of any kind, including but not limited to financial, investment, or gambling advice. AI outputs may be inaccurate, incomplete, inconsistent, or outdated. You should not rely on AI-generated content as the sole basis for any decision.
We do not guarantee the accuracy, reliability, or completeness of any AI-generated content. Player valuations, trade recommendations, and strategic advice are generated algorithmically and may not reflect actual market conditions or outcomes.
6. Subscriptions and Billing
The Service offers a free tier and a paid subscription tier (“Pro”). The free tier provides access to core analytics features with limited AI usage. The Pro tier unlocks additional features including unlimited AI coaching and the War Room Council.
Pro subscriptions are billed on a recurring monthly basis through Stripe, our third-party payment processor. By subscribing, you authorize us to charge the payment method on file at the then-current subscription rate at the beginning of each billing cycle.
Cancellation: You may cancel your Pro subscription at any time through your account settings or the Stripe customer portal. Cancellation takes effect at the end of your current billing period. You will retain access to Pro features until that date. No partial refunds are issued for unused portions of a billing period.
Price changes: We may change subscription pricing with at least 30 days’ notice. Price changes take effect at the start of the next billing cycle following the notice period. Continued use after a price change constitutes acceptance of the new pricing.
Failed payments: If a payment fails, we may retry the charge and/or suspend access to Pro features until the payment issue is resolved.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to reverse engineer, decompile, or disassemble any portion of the Service
- Use automated tools, bots, or scrapers to access the Service beyond normal usage
- Circumvent, disable, or interfere with any security or access-control features
- Share, resell, or redistribute your account access or Pro subscription
- Impersonate another person or misrepresent your affiliation with any entity
- Interfere with or disrupt the Service or servers/networks connected to it
- Use the Service to harass, abuse, or harm other users or third parties
- Attempt to access other users’ accounts or data without authorization
We reserve the right to suspend or terminate accounts that violate these provisions, with or without notice, at our sole discretion.
8. Intellectual Property
The Service, including its design, code, text, graphics, logos, and other content (“Our Content”), is owned by The Franchise and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on Our Content without our prior written consent.
Player names, team names, and league data accessed through the Sleeper API belong to their respective owners.
9. User Content
“User Content” refers to text, queries, and other input you submit through the Service (e.g., chat messages to Coach AI, questions to the War Room Council). You retain ownership of your User Content. By submitting User Content, you grant us a limited, non-exclusive license to process it as necessary to provide the Service — including transmitting it to third-party AI providers for analysis.
We do not use your User Content to train AI models. See our Privacy Policy for details on how User Content is handled.
10. Service Availability
We strive to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control (including third-party API outages). We are not liable for any downtime or service interruptions.
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will meet your requirements, that results obtained from the Service will be accurate or reliable, or that the Service will be free of errors, viruses, or other harmful components.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE FRANCHISE AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.
Our total aggregate liability for any claims arising out of or related to the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) fifty dollars ($50.00 USD).
13. Indemnification
You agree to indemnify, defend, and hold harmless The Franchise and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
14. Termination
You may terminate your account at any time by contacting us at support@thefranchise.app or through your account settings. Upon termination, your right to access the Service ceases immediately. We may retain certain data as described in our Privacy Policy.
We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. If we terminate your account for cause, no refund of prepaid subscription fees will be issued.
15. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of laws principles. Any disputes arising out of or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of such courts.
16. Changes to These Terms
We may revise these Terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 15 days before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes acceptance of those changes.
We encourage you to review these Terms periodically. The “Effective date” at the top of this page indicates when these Terms were last revised.
17. General Provisions
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Franchise regarding the Service.
Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
